📜 TERMS OF RESERVATION, CANCELLATION & REFUND POLICY

1. RESERVATION TERMS

All reservations must be made through official channels including telephone, website, or authorized booking partners.

• A reservation shall be deemed confirmed only upon receipt of advance payment and issuance of a confirmation voucher/number.
• Room rates are dynamic in nature and subject to change until confirmation.
• Upon confirmation, the selected rate becomes final, binding, and non-negotiable.
• No retrospective adjustment (increase/decrease) in rates shall be permitted once payment is processed.

The total estimated booking value includes room tariff and indicative taxes. However:

• Applicable taxes, levies, and statutory charges shall be as prevailing at the time of stay, and any difference shall be payable by the guest.

All billing shall be conducted in Indian Rupees (INR). Any currency conversion displayed is indicative and non-binding.

2. PAYMENT TERMS

• The Resort reserves the right to require 100% advance payment for confirmation.
• Accepted modes: Cash, UPI, Debit/Credit Card, or Bank Transfer.
• Corporate reservations must be supported by authorized company confirmation or advance payment.

3. OCCUPANCY POLICY

• Standard occupancy: Two (2) adults per room.
• Additional occupants (subject to room capacity) shall be charged as per prevailing tariff.

4. CANCELLATION POLICY

Cancellation Notice Requirements:

Total Reserved Room Nights| Minimum Notice Period
Up to 4 nights| 48 hours
5–9 nights| 72 hours
10 nights & above| 7 days

• Cancellation requests must be submitted in writing via email or official communication channel.
• For bookings made via third parties, cancellation must be processed through the respective booking source.

5. NON-REFUNDABLE / PROMOTIONAL BOOKINGS

• All promotional, discounted, or restricted rate bookings are:
• Strictly non-refundable
• Non-amendable
• Such bookings are subject to availability and may carry additional restrictions.

6. REFUND POLICY

• Eligible refunds shall be processed within 2 to 4 weeks from the date of approval.
• Refunds shall be credited only to the original mode of payment.
• Processing timelines are subject to:
• Banking cycles
• Payment gateway procedures

In case a reservation is not confirmed, any amount received shall be released in full.

7. NO-SHOW POLICY

Failure to check-in on the confirmed arrival date shall be treated as a No-Show, resulting in:

• Automatic cancellation of the reservation
• Retention of 100% of the booking amount
• No refund or adjustment permitted

8. EARLY CHECK-OUT / SHORTENED STAY

• Guests checking out prior to the confirmed departure date shall be liable to pay for the entire reserved duration.
• No refund shall be provided for unused nights.

9. MODIFICATION POLICY

• Any modification to an existing reservation is subject to:
• Availability at the time of request
• Applicable rate revisions

The Resort reserves the right to decline modification requests.

10. CHECK-IN & CHECK-OUT

• Check-in Time: 02:00 PM
• Check-out Time: 12:00 Noon
• Early check-in or late check-out:
• Subject to availability
• May attract additional charges unless pre-approved

All guests must present valid Government-issued Photo Identification at check-in.

11. CHILD POLICY

• Children up to 5 years: Complimentary stay (without extra bed)
• Children 6–12 years: Chargeable as per policy
• Above 12 years: Considered as adults

12. SPECIAL REQUESTS

All special requests (including room preference, early check-in, transportation, etc.):

• Are subject to availability
• Do not constitute a guaranteed service unless confirmed in writing

13. ALTERNATE ACCOMMODATION

In the unlikely event of non-availability due to operational exigencies, the Resort reserves the right to:

• Provide alternate accommodation of similar category, or
• Offer an appropriate resolution at its sole discretion

No additional liability shall arise.

14. LEGAL, LIABILITY & DISPUTE RESOLUTION

Governing Law & Jurisdiction

This agreement shall be governed by the laws of India. All disputes shall fall under the exclusive jurisdiction of courts in Lucknow, Uttar Pradesh.

Binding Acceptance

By confirming a reservation, the guest acknowledges and agrees that:

• These terms constitute a legally enforceable contract
• Acceptance is binding irrespective of booking mode (online/offline)

Limitation of Liability

The Resort shall not be liable for:

• Loss, theft, or damage to personal belongings
• Indirect, incidental, or consequential damages

Maximum liability, if any, shall be restricted to the total booking amount received.

Force Majeure

The Resort shall not be held liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to:

• Natural disasters
• Government actions or restrictions
• Pandemics, strikes, or technical disruptions

In such cases, resolution shall be at management discretion.

Fraud & Misrepresentation

The Resort reserves the right to cancel or refuse any booking that:

• Appears fraudulent
• Is made with malicious intent
• Involves misrepresentation of information

Chargeback & Payment Disputes

Any chargeback initiated without prior written communication with the Resort shall be treated as fraudulent intent. The Resort reserves the right to:

• Submit transaction records, signed documents, and ID proof as evidence
• Initiate legal recovery proceedings

Indemnification

The guest agrees to indemnify and hold harmless the Resort against:

• Damages to property
• Legal violations
• Misconduct during the stay

Right to Admission

The Resort reserves the absolute right of admission in the interest of safety, security, and policy compliance.

Digital Validity

Electronic records including emails, OTP confirmations, and digital payments shall be considered legally valid and admissible evidence.

15. DATA & PAYMENT SECURITY

All personal and payment information is processed through secure and encrypted systems in compliance with standard data protection practices.

By proceeding with the reservation, the guest confirms that they have read, understood, and agreed to all terms outlined above, including cancellation, refund, and legal conditions.
